Accessing and/or using this portal makes you a USER, who accepts, from the moment of said access and/or use, the General Conditions of Use listed here. The aforementioned Conditions will apply regardless of any General Contracting Conditions that may be mandatory.

The authorization for the transformation of photographic material that the user grants to Fotoretoque S.L. by accepting the General Terms and Conditions does not imply any transfer of intellectual or industrial property rights to Fotoretoque S.L., which is limited to retouching said photographic material in accordance with the instructions established by the user. The ownership of the intellectual property rights derived from the result of the transformation shall in all cases correspond to the USER.

THE USER warrants to Fotoretoque S.L. that it is the holder of the intellectual and/or industrial property rights derived from the photographic material being processed, as well as the image rights of the persons appearing in these photographs, or that has the appropriate authorization of the holder or holders of these rights to order their transformation by the Company. Consequently, the USER exempts Fotoretoque S.L. from any liability that may arise from the third-party claim in relation to with the transformation carried out, as well as in relation to the intellectual or industrial property rights of said photographic material, and in relation to the image rights of the people appearing in the photographs that are the subject of the contracted services, with the user being directly liable for paying the full amount of any damages that may be claimed. as well as all expenses including lawyers, incurred by Fotoretoque S.L. to address such claims.

6.- DISCLAIMER OF WARRANTIES AND LIABILITY

Fotoretoque S.L. shall not be liable, under any circumstances, for damages of any kind that may be caused, including but not limited to: errors or omissions in the content, lack of availability of the portal, or the transmission of viruses or malicious or harmful programs in the content, despite having taken all the necessary technological measures to prevent this.

7.- MODIFICATIONS

Fotoretoque S.L. reserves the right to make any changes it deems appropriate to its website without prior notice, and may change, delete, or add both the content and services provided through it and the way in which they are presented or located on its website.
